Nebraska passes Ignition Interlock legislation, while ABI fights it in Ohio.

Sarah Longwell, who is the managing director for American Beverage Institute, was in the Ohio Statehouse last week.  She seems to pop up just about anywhere ignition interlock laws are in the works lately.  Ms. Longwell is obviously out fighting to protect the people that she represents and their profits, but at what cost?  She made a comment that, "This bill mandates that people one sip away from 0.0799 receive a punishment normally reserved for high-(blood-alcohol-content), repeat offenders,"  Truth is most legislation gives increased sanctions for those who are repeat offenders.  She has also made comments to the effect that ignition interlock legislation would prevent someone from having a beer at a ball game, or a glass of wine with dinner.  She somehow forgets that ignition interlocks are not being installed on people who have not already shown a lack of ability to stay under the LEGAL limit of .08.  Even though she says it is more dangerous to talk on a cell phone while driving than to be at .08.

Another interesting statement that she made, "While both have committed a crime, they are very different types of criminals.".  I want to ask her how someone becomes a repeat offender without ever being a first time offender?  She often tries to separate repeat offenders from 1st time offenders as two completely different groups of people.  I know it may seem like a hard concept but repeat offenders were 1st time offenders at one point as well.  As New Mexico has shown, implementing ignition interlocks for 1st time offenders has the ability to lower alcohol related accidents by 35%. 

Even while the ABI opposes ignition interlock laws states are seeing through to the facts.  Many states have ran and passed new or enhanced ignition interlock laws.  Although the first time offender ignition interlock bill in Kansas this year will be studied over the summer, Nebraska Senate passed LB 497 this session. 

LB 497 expands and broadens the use of ignition interlock in Nebraska.  This bill now includes interlock for all first offenders who refuse to take a preliminary breath test.  First time refusal now will end in the use of ignition interlock in Nebraska as well.  LB 497 has been signed by the Governor and has an emergency clause that makes it effective immediately. 

Nebraska Woman Arrested for DUI, Child Abuse

Below is a press release put out by Sarpy County Sheriff Department.  Unbelievable story of what the disease of alcoholism can make a person do.  If she would have had an ignition interlock she would have been forced to either walk to get her alcohol or have someone bring it to her.  Smart Start of Nebraska has two locations to have an ignition interlock device installed a very short drive from where this lady was arrested.

Sarpy County Sheriff arrested Krista Kay STIRES, age 30 of Bellevue this morning after a traffic stop.  The arrest was made near Kennedy Freeway (H.75) south of Bellevue.  STIRES was arrested for 4th offense DWI, Intentional Child Abuse and Driving under Suspension/Revocation.  She is currently being held with out bond at the Sarpy County Jail.
STIRES was arrested at 7:51 AM and tested over the legal limits of BAC .08.  Her Nebraska driving privileges are suspended/revoked from a previous DWI conviction.
It was discovered that STIRES had left her 3 ½ month old baby at home alone while she drove to replenish her alcoholic beverage supply.  The baby was removed and placed in care of Nebraska Health and Human services.

FaceBook posts lead to busted party.

Interesting story here.  The following shows a FaceBook post that turned into the arrest of several minors drinking.  I guess you should be careful who you invite to your party, you never know who might show up.  A great piece of law enforcement here.  Keep up the good work.

 

Sarpy County Sheriff Department in conjunction with the Nebraska State Patrol, Papillion, LaVista and Bellevue Police made numerous arrests tonight after raiding an underage drinking. This investigation started after a posting on Face Books advertising a “History Making Party” to take place.  Live DJ, photographer to capture the event, Host also indicted that he had a police scanner to warn if police were to take action.  He also provided a shuttle service to get the people to the party from the Shadow Lake Shopping center in Papillion.   The posting stated the party was to start at 9 PM and run until 5 AM Sunday.

After an undercover officer and 2 minors entered the party at approximately 9:30 PM on April 25th, 2009 at 11306 South 58th Street in Papillion, numerous alcoholic beverages as well as several other minors were also observed consuming alcoholic beverages.  Officers entered the house with a Search Warrant and recovered 5 kegs of beer plus numerous other alcoholic beverages.  9 arrests for Minor in Possession of alcoholic beverage were made at the house.  Officers arrested six individuals at the house for Procuring alcohol for a Minor including both residents.

Those arrested included:

Jared D. Gable, age 22 ,  9750 Fowler Dr., Papillion.

Cassandra Phalen, age 19,  11306 S. 58

Christopher Phalen, age 22 also of 11306 S. 58th Street

Marques L. Parker,  1009 Leavenwor th Street Omaha

Josef Svoboda, age 19, 7711 South 73 Ave, LaVista

One 17 year old juvenile female was also arrested for procuring; her name was not released due to her age.

At the same time of this arrest patrol officers answered a fight/disturbance call in the 140th Street and Harrison area.  Another large MIP party was also found.  Numerous arrests were made for that party as well as one arrest for procuring alcohol for a minor.

In both of these cases, the parents were out of town.

Seven Stopped for DUI in Grand Island, Nebraska Checkpoint.

Troopers with the Nebraska State Patrol Troop C Headquarters- Grand Island, arrested seven drivers for driving under the influence.  This enforcement effort was a success, removing impaired drivers and making roads safer in Nebraska.

Support Kansas DUI legislation!

In 2007, 114 people were killed in drunk driving crashes in Kansas. This accounts for over 27 percent of total traffic fatalities statewide. Countless more people were injured.

Fortunately, there is a technology that has the potential to eliminate these preventable deaths and injuries -- the ignition interlock. These sophisticated devices can prevent a vehicle from being driven by a drunk driver. If they are used correctly -- in concert with treatment, in addition to hard license suspensions and in the vehicles until they are no longer needed -- they can stop repeat offenses.

On March 4, the House Judiciary Committee heard House Bill 2315 which would require interlocks for all convicted drunk drivers. Your voice and support is needed to urge Members of the House Judiciary Committee to vote in favor of this lifesaving legislation. The committee may be voting on the legislation as soon as this week.

People who have previous drunk driving convictions make up approximately one-third of the drunk driving problem in America. And first time offender doesn’t mean first time driving drunk. Studies have shown the average first-time drunk driving arrestee has driven drunk 87 times before, and those numbers are conservative estimates. That means a first-time arrestee has had 87 chances to kill or injure someone.

Suspending a drunk driver’s license isn’t enough. More than half of those convicted of drunk driving continue to drive on a suspended license. And there is nothing in place to prevent them from driving drunk again.

Studies have shown that ignition interlocks can decrease repeat offenses by 64 percent.  Current technology is here and can reverse this trend, but the laws haven't caught up to the technology. We need strong laws making interlocks mandatory for ALL convicted DUI offenders.

Fox and Friends debates Ignition Interlock

Tony Fulton, Nebraska State Senator, and Sarah Longwell, ABI, were both guests on Fox New's show Fox and Friends.  As usual Ms. Longwell argued the point that DUI offenders should not have interlock devices if they were just out having beers at a ball game, or drinking wine with dinner.  The only offender that she believes should have an interlock mandated are those blowing high BrAC levels at the time of arrest, or repeat offenders. 

Senator Fulton continued to display his foresight on the issue, siting relevant statistics that led the Nebraska Legislature to unanimously pass their 1st time offender ignition interlock bill.  He expressed that Nebraska fully intends to use the available technology to protect the citizens of Nebraska.  He also made it very clear to Ms. Longwell that in Nebraska the punishment does fit the crime. 

 

Ms. Longwell works for the American Beverage Institute.  What exactly would you think she is getting paid to do here?  Not surprising that she is against a law that would make people think twice before heading out for an evening of drinking.

Gage County Nebraska Receives Grant

"The Nebraska Office of Highway Safety recently announced that Gage County will participate in the national DUI “You Drink and Drive, You Lose” campaign."

Nebraska Cracks down on DUI over holiday.

During the holiday "You Drink, You Drive, You Lose" campaign troopers will put in extra hours to protect Nebraska roadways.  The Nebraska Office of Highway Safety (NOHS) grant of $27,000 will cover additional overtime hours.

Extra enforcement of accident causing violations will conducted in the following areas; Lincoln, Omaha, Norfolk, Grand Island,North Platte and Scottsbluff.

Omaha Nebraska Ignition Interlock Wet Lab Demonstration

On December 1st I posted about the Wet Lab ignition interlock demonstration.  The demonstration went very well thanks to the incredibly hard work of Russ Zeeb of the Sarpy County Sheriff's Department.  Others that made it possible were Fire Guard, Sim Reynolds and the MADD Nebraska office, Fred Zwonechek of the Nebraska Office of Highway Safety, Rick "Q" Quistad of Jones Automotive, PRIDE Omaha, Craig Kelly, and AAA Nebraska. Many others offered their time and effort including virtually every law enforcement agency in the surrounding counties. 

Those who were part of this demonstration all did so in an attempt to accomplish the same goal.  This common goal is the to protect the roads, and save lives of Nebraskans during this holiday season and beyond.  I personally want to wish all a safe and happy holiday!
