Interlock Law a “Gift” to Nebraska Drivers

The Omaha World Herald ran an article on the front page yesterday about the new ignition interlock law in Nebraska. The new law will start on January 1, and will change the way any DUI offense is handled after that.

Generally speaking the new law will allow anyone who is willing to waive their right to an ALR hearing the ability to immediately get an ignition interlock and drive. This in large part is to prevent the thousands of hearings that Nebraska is having to conduct, and the overtime associated with paying overtime to officers to attend them. Want an ALR hearing anyway? That is fine and you have that right, but if you lose you will be suspended from driving until the proceeding is complete. More or less, if you are going to fight the ALR, make sure you can win.

Kansas First (1st) Offense DUI Administrative Penalties

What are the penalties for a 1st offense DUI in Kansas? Well there are a few factors that will help you determine this. We first need to get a little info to give you good information.

Did you take the test or refuse it?
If you took the test what was the result?

I took the test and blew .08 – .149

If you took the test and blew below a 0.150 then you are going to have a license suspension, followed by an ignition interlock requirement.

30 day license suspension. This will be a period of no driving at all. You will then be required to provide proof to the DMV that you have completed 180 days*, or six months*, of ignition interlock before your license will EVER be reinstated. This is important because you can not wait this time period out. You will be permanently in a state of “restricted to driving only a vehicle equipped with an ignition interlock device” until you provide them proof. This paperwork is provided to you in a letter from the state and we will also provide you with this at your installation, fax it to the state for you, and continually send compliance paperwork electronically on your behalf until your time is complete at no charge to you.
*If you have a previous offense of Minor In Possession, Minor In Consumption, Habitual Violator, or had your license previously revoked, cancelled or suspended you will be required to have the interlock on for one year instead of the 180 day restriction.
Things to Know:
- Make sure your paperwork is completed properly. We will be happy to assist in this at no charge. Contact us for free help.
- DON’T DRIVE WITHOUT THE INTERLOCK. If you are stopped without the interlock you can incur long additional suspension, restarting the interlock period and additional criminal penalties. Some of these penalties are worse than the original DUI.

I took the test and blew over a .150

If you took the test and blew over a 0.150, you are going to have a 1 year license suspension, followed by a one year ignition interlock requirement.

- You must apply for the license modification, AND not be suspended revoked or cancelled for any other reason or they will keep your $100 and not approve your request. You need to have your license cleaned up and fines paid before making the application process. Everything needs to be cleared except the DUI. - After being approved you will need to have a state certified Ignition Interlock installed. Choose from any of our locations to be installed and save time by scheduling online.
- Once installed we will submit this to the DMV, but you ARE NOT legal to drive yet. You must wait until you receive confirmation from the DMV that they have received your paperwork before you are legal to drive. While it may not take that long, the DMV can take 2 to 3 weeks before getting you this paperwork in the mail.
- Once the suspension time has been completed you will be free to drive unrestricted, as long as it is a vehicle with an ignition interlock device.
- You can wait out the suspension time, but the requirement for the interlock device will not clear until they receive proof from a certified provider.

I refused the test and have been charged with a 1st offense test refusal.

KC Checkpoint takes 14 Off the Road

Kansas City checkpoint ended with 14 arrested. This was out of a total of 332 drivers over a 5 hour period. Checkpoints continue to prove their effectiveness at removing intoxicated drivers from the road.

New Mexico Finds Indigent Program Was Flawed

New Mexico had an indigent program setup to pay for offender who could not afford the ignition interlock device on their vehicle. They have now found that the nearly one third of the states participants who claimed they could not afford it, were actually scamming the system. Offenders are now required to meet strict standards to qualify for the funding.

Kansas currently requires proof of qualification for state and federal assistance. This seems to limit the numbers to only those who actually qualify for the program.

Nebraska has revised their qualifications as well after a time period of apparent misuse.

Mom Face DUI after wreck at school

A mother was charged with DWI after having a wreck in the parking lot of her daughters school. An Ignition Interlock will now be in her future, preventing her from endangering the lives of her and her daughter. Not to mention the lives of the other school children. Nebraska has recently passed legislation increasing penalties for DUI when a child is in the vehicle. This may be legislation that should be looked at.

With the new Kansas DUI Law in effect anyone who has previously been suspend due to an alcohol related offense can apply to drive again. There are many different situations that an individual could be in so make sure you make an informed decision. A few guidelines to consider are as follows.

ATTENTION: We would be happy to help you complete any of this paperwork, at anytime. The $100 fee is non-refundable and we would be happy to help make sure you only pay it once. We are available to help you through the process, at no cost to you.

FOR RETROACTIVELY CHANGING A PREVIOUS PENALTY FOR A DUI OFFENSE

You must have served at least 45 days of any alcohol related suspension.
You must not be suspended or revoked for any other reason at time of application.
You must mail a NON-REFUNDABLE $100 application fee.
Your penalty will be modified to the new penalties. This means your current penalty will be converted to whatever the penalty is for your offense under the new law.
There are 4 SITUATIONS WHERE THIS ADDS AN ADDITIONAL YEAR(S) to your penalty. If you have a 3rd or 4th offense for a .08-.149 DUI or a 2nd or 3rd offense for test refusal, please contact us first to discuss how this can impact you.
You may be denied for reasons not associated with your DUI. A list of possible reasons you may/could be denied are listed below.
You must have receive confirmation that you were approved before you can legally drive. Even with an ignition interlock device installed.

Reasons for the denial of an application may include, but not be limited to, the following suspension types
existing on the applicant’s record: 1) failure to appear in court on a traffic citation; 2) failure to maintain required
liability insurance coverage on a vehicle at the time of an accident or traffic stop; 3) failure to file or maintain
evidence of liability insurance on record with the Driver Control Bureau; 4) failure to comply with a child support
order; and/or 5) determined to be a habitual violator.
